Terms of Use

1. Eligibility

To use Firefly, you must:

- Be at least 18 years old (minors are strictly prohibited).

- Complete Firefly’s mandatory live selfie verification process during account creation.

- Reside in Ontario (Firefly is currently available only in Ontario).

- By creating an account, you confirm that you meet these eligibility criteria.

2. Account Creation and Security

- Mandatory Verification: All users must complete live selfie verification during account creation to ensure authenticity and build a safe community. Failure to complete this mandatory verification will result in account restrictions or suspension.

- Account Information: You must provide accurate and truthful information, including your name, email address, phone number, and date of birth.

- Account Security: You are responsible for maintaining the confidentiality of your account credentials. Notify Firefly immediately of any unauthorized access or breaches.

- Optional ID Verification: Users may choose to provide a government-issued ID for additional verification and a verification badge.

3. User Content and Conduct

a) Content Restrictions

Users are prohibited from posting or sharing content that:

- Contains nudity, sexually explicit material, or offensive language.

- Promotes illegal activities or violence.

- Violates another user’s privacy or intellectual property rights.

- Harasses, abuses, or discriminates against others.

Firefly reserves the right to remove content that violates these guidelines and penalize offending users, up to and including account suspension.

b) User Responsibility

You are solely responsible for all content (e.g., profile photos, audio clips, chat messages) you upload to Firefly.

By uploading content, you grant Firefly a royalty-free, worldwide license to use, display, and distribute it for service functionality and promotional purposes.

4. Sparks

a) Spark Hosting and Participation

- Sparks may only be hosted at public addresses (e.g., cafes, parks) to ensure safety. Sparks in private or residential addresses are prohibited.

- Firefly is not responsible for any disputes, cancellations, or issues arising between Spark participants.

- Firefly is not liable for any lost, stolen, or damaged goods during Sparks. Firefly is also not involved in or responsible for any illegal activities or crimes that may occur during Sparks.

b) Spark Behavior Guidelines

Participants must adhere to Firefly’s Community Guidelines during Sparks. Behavior guidelines include:

- Respectful communication with other participants.

- Avoiding disruptive, unsafe, or inappropriate activities.

- Complying with all local laws and safety practices during Sparks.

- Violations of these guidelines may result in penalties, including account suspension.

5. Ratings and Feedback

After each Spark, participants are required to submit mandatory ratings and feedback on other participants, focusing on behavior, punctuality, and overall experience.

Firefly reserves the right to investigate and remove unfair ratings or feedback based on evidence. Misuse of the ratings system may result in account penalties.

6. Prohibited Conduct

You agree not to:

- Create fake accounts or impersonate others.

- Harass, stalk, or harm other users, either through the app or during Sparks.

- Use Firefly to engage in illegal activities or promote violence.

- Attempt to reverse-engineer, hack, or disrupt Firefly’s services.

- Share or collect other users’ personal data without consent.

- Firefly will cooperate with law enforcement for any illegal activity reported in connection with Sparks or the app.

7. Reporting and Bans

- Reporting: Users can report inappropriate behavior or violations of these Terms through the app. Reports will be reviewed promptly.

- Account Bans: Users found violating Firefly’s rules may face account suspension or termination.

- Appeals: Banned users can contact support at hello@fireflyspark.io to appeal the decision.

- Retention of Reports: Reports and flagged data are retained indefinitely for safety and investigation purposes.

8. Location Sharing and Safety

- Real-Time Location Sharing: Users can share their real-time location with Spark participants by pressing "On My Way." This data is shared only during active Sparks.

- Risks of Sharing Location: Firefly advises users to exercise caution when sharing location data, as misuse by other participants is beyond Firefly’s control.

- Liability Disclaimer: Firefly is not liable for actions taken by users after obtaining location data.

9. Privacy

Your use of Firefly is subject to our Privacy Policy, which outlines how we collect, use, and protect your data. By using Firefly, you agree to the practices described in the Privacy Policy.

10. User Content Ownership

Users retain ownership of the content they upload (e.g., photos, audio recordings). By uploading content, you grant Firefly a non-exclusive, royalty-free license to use, modify, and display the content for app functionality and promotional purposes. Firefly reserves the right to remove user content at its discretion, even if it does not explicitly violate these Terms.

11. Limitations on Liability

- Firefly does not guarantee successful connections or matches and is not responsible for the outcomes of in-person meetings.

- Firefly is provided “as is,” with no guarantees of uninterrupted service.

Firefly is not responsible for:

- User interactions during Sparks.

- Injuries, damages, or disputes arising from Sparks.

- The accuracy of location or profile data shared by users.

12. Updates to These Terms

Firefly reserves the right to update these Terms at any time. Updates take effect immediately upon notification via in-app banners or push notifications. Continued use of the app constitutes acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of Ontario, Canada. Any disputes will first be mediated before proceeding to litigation. Firefly reserves the right to extend this clause to other jurisdictions as the app expands.
